Terms of Service

1. Acceptance of Terms

By accessing or using PlayerTracker Pro (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use our Service.

We may modify these Terms at any time. Your continued use of the Service after any changes constitutes acceptance of the new Terms. We will notify you of material changes via email or through the Service.

2. Eligibility

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

You are responsible for ensuring that your use of PlayerTracker Pro complies with all applicable laws in your jurisdiction, including any laws related to online gaming or poker.

3. Description of Service

PlayerTracker Pro is a poker player tracking application that helps users track and analyze player statistics from ClubWPT Gold. The Service includes:

  • A desktop agent that extracts player data during gameplay
  • A web dashboard for viewing and managing player statistics
  • Cloud synchronization of your player database
  • Note-taking and tagging features for players

4. Account Registration

To use the Service, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized use of your account
  • Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used for fraudulent or illegal purposes.

5. Subscription and Payment

Subscription Plans

PlayerTracker Pro offers subscription-based access. Current pricing and features are displayed on our website. We reserve the right to modify pricing with 30 days notice to existing subscribers.

Billing

  • Subscriptions are billed in advance on a monthly or annual basis
  • All payments are processed securely through Stripe
  • You authorize us to charge your payment method for all fees
  • Failed payments may result in service suspension

Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial billing periods.

Free Version

We offer a feature-limited free version that allows tracking of one table at a time. Additional tables and player data are hidden until you upgrade to a paid subscription. The free version does not expire and no credit card is required.

6. Acceptable Use

You agree NOT to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Harass, abuse, or harm other users or players
  • Attempt to gain unauthorized access to our systems
  • Reverse engineer or decompile our software
  • Use the Service for any illegal gambling activity
  • Share your account credentials with others
  • Circumvent any access restrictions or usage limits
  • Transmit malware, viruses, or harmful code
  • Use automated systems to access the Service (except our official agent)

7. Intellectual Property

The Service, including its design, code, features, and content, is owned by PlayerTracker Pro and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes.

You retain ownership of your own data (player notes, tags, etc.) that you input into the Service. By using the Service, you grant us a license to store, process, and display your data as necessary to provide the Service.

8. Third-Party Services

PlayerTracker Pro interacts with ClubWPT Gold to extract player data. We are not affiliated with, endorsed by, or officially connected with ClubWPT or any of its subsidiaries or affiliates.

Your use of ClubWPT Gold is governed by their own terms of service. You are responsible for complying with their terms. We are not responsible for any actions taken by ClubWPT or any third party regarding your use of our Service.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR COMPLETENESS OF DATA
  • UNINTERRUPTED OR ERROR-FREE OPERATION
  • SECURITY FROM UNAUTHORIZED ACCESS

We do not guarantee that player statistics are accurate or that the Service will always function correctly. Poker involves inherent uncertainty, and our statistics are for informational purposes only.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLAYERTRACKER PRO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

  • ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
  • DAMAGES RESULTING FROM YOUR USE OR INABILITY TO USE THE SERVICE
  • DAMAGES RESULTING FROM ANY UNAUTHORIZED ACCESS TO YOUR DATA
  • GAMBLING LOSSES OR ANY FINANCIAL DECISIONS MADE BASED ON OUR DATA

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNTS PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless PlayerTracker Pro and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third party's rights
  • Your violation of any applicable laws

12. Termination

We may terminate or suspend your access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Non-payment of subscription fees
  • Request by law enforcement or government agencies
  • Discontinuation of the Service

Upon termination, your right to use the Service will immediately cease. You may request an export of your data within 30 days of termination.

13. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules.

Class Action Waiver: You agree that any arbitration or proceeding shall be limited to the dispute between you and us individually. You waive any right to participate in a class action lawsuit or class-wide arbitration.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PlayerTracker Pro regarding the Service. These Terms supersede any prior agreements or understandings.
